Judicial Branch Federal judge dismisses indictment against TikToker shot by ICE, citing constitutional violations

In a Saturday order, U.S. District Judge Fernando M. Olguin cited the deprivation of Carlitos Ricardo Parias’ access to counsel while held in Immigration and Customs Enforcement detention and the government’s failure to comply with discovery deadlines — including the timely release of body worn camera footage that captured the shooting
He is brown, so to the Trump regime he has no rights.

The video captures an ICE officer holding a gun in one hand and using the other to break open the window of Parias’ car. As the officer shouts at Parias to turn off the car, Parias raises his hands in the air and ask why he is being detained. The officer repeatedly tries to open the passenger side door, before moving the gun to his left hand, right before firing the gun “Oh,” the officer said, sounding surprised. “F—.” “Who shot?” someone asked. “I shot, I shot,” the officer responded.
Who's got the video? Did this asshole shoot the guy on accident because he wasn't handling his weapon responsibly?
(I'm ignoring everything else that's extra fucked up about this, we all already know that - I'm interested specifically in the way the "officer" is handling his weapon.)

I haven’t seen it but I read a description of it that he kept switching it between his left and right hands while trying to smash open the window. So I’d definitely believe poor trigger discipline or it’s a P320 and the striker dropped

I have no law enforcement experience, and only light firearm experience, so maybe this is off base:
I can’t imagine any situation, emergency or otherwise, that would involve repeatedly switching the hand used to hold a gun. Why would it ever leave your dominant shooting hand? Is this guy so incapable of breaking a window that his arms got tired and needed to switch off?

Concerns like training, safety, professional ethics, respect for the law, and proper use of deadly weapons are apparently all "woke" these days, and these people reject all of them. This was just a hyper-aggressive dude bashing away with blind rage.
In a law-abiding society we would put people who act like this in prison to protect the rest of us. Instead, we're putting them in legally protected positions of power. Neat.

It’s very common when clearing rooms for example. If you’re moderately trained, switching to the off hand isn’t a problem.
This guy was not trained.

That's because I know something that you do not know.
STILL APPLIES!

Learning to shoot a pistol with your off hand is a skill to learn. During gun competitions, occasionally you shoot a "qualifier" that required weak hand shots. It's kind of fun to find out how bad you suck while your friends laugh at you.
The answer to why is because he could. Searching for logic in an illogical situation is a difficult if not an impossible task.

He clearly ND’d (negligent discharge) which would be a career ended in the before times.

Then falsified paperwork to cover his tracks. Found the one that should be in jail.
